Permanent Jewelry Terms & Conditions
By booking an appointment or purchasing permanent jewelry from Everly Designs, you acknowledge that you have read, understand, and agree to the following terms and conditions.
Permanent Jewelry
Permanent jewelry is designed to be worn continuously and is welded closed without a traditional clasp. Although it is referred to as “permanent,” it can and should be removed by cutting the chain when necessary.
Because permanent jewelry is custom-sized and welded specifically for each client, all permanent jewelry sales are final once the chain has been cut and fitted.
Sizing & Fit
Each piece is sized with the client prior to welding. The client is responsible for approving the fit before the piece is permanently closed.
Once the fit has been approved and the jewelry has been welded, Everly Designs is not responsible for changes in fit caused by swelling, weight changes, growth, stretching of the chain, or other circumstances occurring after the appointment.
Breakage, Loss & Damage
Permanent jewelry is still jewelry and is not indestructible.
Chains are intentionally delicate enough to break or be cut if necessary for safety. Jewelry may stretch, snag, break, become damaged, or be lost during normal wear.
Everly Designs is not responsible for jewelry that is lost, stretched, snagged, broken, damaged, or removed after the client leaves the appointment.
If you still have your chain and it can safely be reused, please contact Everly Designs regarding re-welding or repair options. Replacement of lost chain, charms, connectors, or other components may require an additional charge.
Metal Sensitivities & Allergies
Everly Designs offers jewelry in materials including 14k gold-filled, sterling silver, and enamel components.
Clients are responsible for informing Everly Designs of any known metal allergies or sensitivities before receiving jewelry.
Individual skin reactions can vary. Everly Designs cannot guarantee that a client will not experience irritation, discoloration, sensitivity, or an allergic reaction.
If irritation or another concerning reaction occurs, the jewelry should be removed.
Welding & Safety
Permanent jewelry is closed using a precision jewelry welder. Appropriate safety procedures and protective measures are used during the welding process.
By choosing to receive permanent jewelry, the client voluntarily consents to the welding process and understands that, although precautions are taken, any service involving tools and equipment carries some risk.
Clients agree to follow instructions provided by Everly Designs during the welding process.
Medical Procedures & Emergency Removal
Permanent jewelry may need to be removed for certain medical procedures, imaging, surgeries, emergencies, athletics, employment requirements, or other circumstances.
Always follow the instructions of your physician, medical provider, employer, coach, or other appropriate professional regarding jewelry removal.
Permanent jewelry can be removed by carefully cutting the chain at the jump ring or another appropriate location.
If your jewelry must be removed for a medical reason and you retain the chain in usable condition, Everly Designs offers complimentary re-welding when possible.
Minors
Clients under 18 must have permission from a parent or legal guardian before receiving permanent jewelry.
A parent or legal guardian may be required to be present and/or provide consent at the discretion of Everly Designs.
Everly Designs reserves the right to decline permanent jewelry for a child if the jewelry cannot be safely fitted or if the service is otherwise considered inappropriate or unsafe.
Appointments & Children
Children are always welcome at Everly Designs appointments.
However, because jewelry welding equipment, tools, and small jewelry components are present, parents and guardians are responsible for supervising children accompanying them throughout the appointment.
Mobile Appointments & Travel
Mobile appointments are available within Asheville and surrounding areas.
A $25 deposit is required at the time of booking for mobile appointments. The deposit will be applied toward the final appointment total.
Appointments requiring travel outside the normal service area may be subject to an additional travel fee. Any applicable travel fee will be discussed and agreed upon prior to the appointment.
Cancellations & Deposits
Mobile appointment deposits are refundable when the appointment is canceled at least 24 hours before the scheduled appointment time.
Cancellations made less than 24 hours before the appointment, as well as no-shows, may result in forfeiture of the deposit.
Everly Designs understands that emergencies happen and reserves the right to make reasonable exceptions at its discretion.
If Everly Designs must cancel an appointment, the client may choose to have the deposit refunded or transferred to a rescheduled appointment.
Late Arrivals
Please contact Everly Designs if you are running late.
Depending on the appointment schedule, significant lateness may require the appointment to be shortened or rescheduled. Any deposit associated with the appointment may be transferred or forfeited depending on the circumstances.
Pricing & Payment
Pricing is based on the chain, charms, connectors, and other jewelry selected at the appointment.
The client will have an opportunity to review pricing before the jewelry is cut and welded.
Payment is due at the time services are provided unless otherwise arranged.
Refunds
Because permanent jewelry is custom-cut and fitted to the individual client, completed permanent jewelry purchases are final and non-refundable.
If there is a problem with your jewelry that you believe is related to the original weld or workmanship, please contact Everly Designs so the issue can be reviewed.
Normal wear, accidental damage, loss, snagging, stretching, improper care, or damage occurring after the appointment is not considered a manufacturing or workmanship defect.
Right to Refuse or Stop Service
Everly Designs reserves the right to refuse, postpone, or stop a service when there is a safety concern, inappropriate behavior, inability to safely perform the service, or another circumstance that makes continuing the appointment unreasonable.
Assumption of Risk
By choosing permanent jewelry, the client acknowledges the nature of permanent jewelry and voluntarily accepts the ordinary risks associated with wearing it, including snagging, breakage, skin irritation, loss, or the need for removal.
Nothing in these Terms & Conditions is intended to waive any right or protection that cannot legally be waived under applicable law.
